Public Offer Agreement
Individual Entrepreneur Natalia Mulcahy, operating through the online store www.postal-shop.ru (hereinafter referred to as the SELLER), publishes this agreement which constitutes a public offer addressed to individuals and legal entities (hereinafter referred to as the BUYER) on the following terms.
1. Subject of the Agreement
1.1. The SELLER agrees to transfer ownership of goods presented in the online store www.postal-shop.ru (hereinafter referred to as the GOODS) to the BUYER, and the BUYER agrees to pay for and accept the GOODS in accordance with the terms of this Agreement.
2. Moment of Conclusion of the Agreement
2.1. This Agreement constitutes a public offer in accordance with Articles 435 and Part 2 of Article 437 of the Civil Code of the Russian Federation.
2.2. Placing an order on the website of the online store constitutes full and unconditional acceptance of the terms of this Agreement (acceptance of the offer).
2.3. From the moment the order is placed, the BUYER is considered to have entered into contractual relations with the SELLER.
3. Price of Goods
3.1. Prices for the GOODS in the online store are indicated in Russian rubles per unit.
3.2. Shipping fees are indicated on the website www.postal-shop.ru.
3.3. The total cost of the order, including shipping, is displayed during checkout.
3.4. The minimum order amount in the online store is 200 (two hundred) rubles excluding shipping costs.
3.5. The SELLER reserves the right to change prices for GOODS listed in the online store at any time. The price of an already confirmed order cannot be changed.
3.6. In case of a technical pricing error, the SELLER reserves the right to cancel the order and notify the BUYER.
4. Payment
4.1. In case of cash payment, the BUYER must pay the full price of the GOODS upon receipt, and the SELLER must provide a receipt or other payment confirmation document.
4.2. For non-cash payments, the BUYER’s payment obligation is considered fulfilled once the funds are debited from the BUYER's account.
4.3. If payment is not completed within the payment system's specified time limit, the order may be cancelled by the SELLER.
4.4. The GOODS are supplied according to the name, quantity and price specified in the order.
5. Delivery
5.1. Delivery of GOODS is carried out to the address specified by the BUYER when placing the order.
5.2. The BUYER must provide accurate and complete delivery information (recipient name, address, postal code and contact phone number). If incorrect or incomplete data is provided, the SELLER is not responsible for delivery delays, failed delivery or return of the shipment.
5.3. If the order is not collected by the BUYER within the storage period specified by the delivery service and is returned to the SELLER, reshipment will be carried out at the BUYER’s expense.
5.4. Delivery times depend on the selected shipping service and destination region and are indicated during checkout.
6. Rights and Obligations of the Parties
6.1. The SELLER agrees to:
6.1.1. Provide the BUYER with information about the main characteristics of the GOODS, price, purchase conditions, delivery, payment and return policies before the agreement is concluded.
6.1.2. Not disclose the BUYER’s personal data except as required by Russian law.
6.1.3. Provide the BUYER with consultation via the contact information listed on the website.
6.1.4. The SELLER reserves the right to modify the terms of this Agreement before acceptance by the BUYER.
6.2. The BUYER agrees to:
6.2.1. Review the terms of this Agreement as well as payment and delivery conditions before placing an order.
6.2.2. Provide accurate information necessary to place and deliver the order.
6.2.3. Pay for and accept the GOODS in accordance with the terms of this Agreement.
7. Liability
7.1. The parties bear responsibility for non-performance or improper performance of obligations in accordance with the legislation of the Russian Federation.
7.2. The SELLER is not responsible for delivery issues if the BUYER provides incorrect delivery address or contact information.
7.3. The SELLER is not responsible for any mismatch between the GOODS and the BUYER's expectations if the product characteristics were correctly indicated on the website.
7.4. The SELLER is not liable for partial or complete failure to fulfill obligations due to force majeure circumstances.
7.5. The BUYER is responsible for the accuracy of the information provided when placing an order.
7.6. All disputes shall first be resolved through negotiations, and if no agreement is reached — through legal proceedings in accordance with Russian legislation.
8. Returns and Exchanges
8.1. Returns and exchanges are carried out in accordance with the legislation of the Russian Federation.
8.2. Detailed return and exchange conditions are published on a separate page of the website.
9. Force Majeure
9.1. The parties shall not be held liable for partial or complete failure to fulfill obligations under this Agreement if such failure is caused by force majeure circumstances.
Such circumstances include extraordinary and unavoidable events such as natural disasters, military actions, epidemics or government decisions that prevent fulfillment of obligations.
10. Term of the Agreement
10.1. This Agreement enters into force from the moment the BUYER places an order and remains valid until all obligations are fulfilled by both parties.
11. Personal Data
11.1. Personal data of the BUYER is processed in accordance with Federal Law No. 152-FZ “On Personal Data”.
11.2. The SELLER collects and processes personal data of BUYERS (full name, delivery address, phone number and email) solely for the purpose of fulfilling this Agreement and delivering the order.
11.3. Providing personal data to third parties acting under a contract with the SELLER for the purpose of delivery is not considered a violation.
11.4. By placing an order in the online store, the BUYER agrees to the processing of their personal data.
11.5. The SELLER may send informational messages to the BUYER’s email or phone with their consent.
11.6. The BUYER may opt out of receiving promotional messages by sending a request to info@postal-shop.ru.
